School Choice for IEP Students: Why Parents Deserve Real Options

Today an IEP student in Shasta County was denied an interdistrict transfer.

Parents were told “no.”

Every school district and government agency loves to talk about school choice. They put it on their websites. They say it in meetings. But when a parent of a child with an Individualized Education Program tries to move their student to a school that can better serve them, the system often slams the door.

This is not real school choice for IEP students. This is bureaucracy deciding what’s best for your child while you pay the taxes that fund the entire system.

Why School Choice for IEP Students Matters

Children with IEPs often need specialized support, smaller settings, or specific programs that may not be available in their assigned school. When those needs aren’t being met, parents should have the ability to choose a better option — just like any other family.

Instead, many IEP families are denied interdistrict transfers. The common excuses are “capacity,” “program availability,” or “district of residence.” The result is the same: parents who know their child best are blocked from making decisions in their child’s best interest.

School choice for IEP students should not be a privilege. It should be the standard.

The Law Supports Parental Rights and Equal Education

California’s Constitution requires a free system of common schools. The California Supreme Court in Serrano v. Priest recognized education as a fundamental right. Federal law under the Individuals with Disabilities Education Act (IDEA) guarantees every child with a disability a Free Appropriate Public Education.

Parents also have a long-recognized right to direct the upbringing and education of their children, affirmed in cases like Pierce v. Society of Sisters.

Yet in practice, ZIP codes and bureaucratic rules often outweigh what’s best for the student.

Parents — Not ZIP Codes — Should Decide

Whether a child has an IEP or not, parents should be able to choose the school where their student has the best chance to succeed. Education should not be limited by artificial district boundaries when a better option exists nearby.

We are all taxpayers. We fund these schools. We have every right to expect a free and equal education for our children in the setting that works best for them.

Childhood Is Sacred

Every year a child spends in a placement that does not meet their needs is a year that cannot be recovered. For students with IEPs, the stakes are even higher. Real school choice for IEP students protects childhood, supports learning, and respects the primary role of parents.

It’s Time for Real School Choice

Parents, do not accept the polite language of “choice” while your options are restricted. Demand that interdistrict transfers for students with IEPs are treated as a meaningful right, not a rare exception.

Demand policies that put parental rights first. Demand that schools serve families instead of trapping them.

School choice for IEP students is not radical — it is common sense. And it is long overdue in Shasta County and across California.
